These general Terms and Conditions apply to you as a consumer when you purchase products from us, Maria Nila AB, reg. no. 556298-9540, at our website marianila.com. By purchasing a product at marianila.com, you confirm that you accept these Terms and Conditions.

When placing an order on the website, a purchase agreement is entered into between you and Maria Nila when we have confirmed your order in writing and you have received our order confirmation. We ask you to save the order confirmation in order to facilitate correspondence with us about your purchase.

You must be at least 18 years old in order to purchase products at marianila.com.

Prices & payment

All applicable prices for products are indicated at marianila.com. We reserve the right to make price adjustments; adjusted prices will be published and held available at our website marianila.com. The prices indicated at marianila.com are in USD and include VAT. In the event a product is listed at an incorrect price due to a typographical or technical error, or any other reason, we preserve the right to refuse or cancel any order placed for such product. 
Our payment provider is Shopify Payments, a payment solution provided by Stripe Payments, Inc. We currently accept payments such as Visa, MasterCard, Klarna Pay Now, Klarna Pay Later, American Express.For more information on how we process payment information, please refer to our Privacy Policy
Please note that when ordering against an invoice the shipping address needs to be your registered residence. For further information about Klarna invoices, you may contact Klarna through their website www.klarna.com.

Shipping & delivery

The listing or description of a product at marianila.com does not imply that the product is presently available in stock.

Orders are delivered by UPS. You will receive an e-mail when your order leaves our warehouse.

Shipping within US is charged 10.00 USD. Shipping within Canada is charged 13.00 CAD. Time of delivery within US/CA is 3-8 days (UPS Standard).

Please note that the time of delivery may vary.

Term and right of withdrawal

These Terms and Conditions are valid for each purchase that you make.

You have the right to withdraw your purchase within a period of 14 days from the day of delivery of the product for any reason or for no reason. If you have ordered more than one product and the products are delivered separately, or if you have ordered a product which is delivered in separate parts at different times, you have the right to withdraw the purchase within 14 days from the day of delivery of the last product or the last part of the product.

If you wish to withdraw your purchase, you must let us know within 14 days from the day of delivery by sending a message to us that you wish to withdraw the purchase and return the product. The message should include your name, address and contact information to you. You may send the message to us by e-mail: americas@marianila.com or by post: Andesitgatan 12, 254 68 Helsingborg. You may also use the Swedish Consumer Agency standard form for withdrawal and send it to us by post or email. You will then have 14 days to return the product to us.

Provided that the product is sealed, unused and returned to us intact and in its original packaging, we will repay you the total costs of the product as well as costs for shipping and return, provided that the product is returned by regular mail.

Please note that you as a customer is responsible for the products during delivery when the product is returned to us. Please package the products in a suitable way in order to mitigate the risk that they are damaged or lost during delivery.

You agree to have sufficient funds or credit available upon placement of any such order to ensure that the purchase price will be collectible by us. After you place your order, we will send you a confirmation email (the “Order Confirmation”). We strive to provide accurate pricing information regarding the Products available on the Site. We cannot, however, insure against pricing errors. We reserve the right, at our sole discretion, to not process or to cancel any orders placed for a Product whose price was incorrectly posted on the Site as a result of an error.

If this occurs, we will notify you by email. The Site may contain information regarding the availability of Products. In rare cases, a Product may be in stock when you place the order, and sold out by the time we attempt to process the order. Should this happen, we will notify you by email and cancel the item from your order. We also may offer some Products for sale before they have been manufactured or arrive at our warehouse. When you preorder these Products, we will ship them out once they are available. In rare cases, these items may not become available for shipping. Should this happen, we will notify you by email and cancel the item from your order Promotions and offers apply as long as the product is in stock. There may be changes in the campaigns over time and we will do everything we can to meet your expectations. In case of problems with orders or changes, we will contact you via email to inform and correct your personal order.

Complaints

If you have received a damaged or defect product, please lodge your complaint to us by e-mail: americas@marianila.com or post: Andesitgatan 12, 254 68 Helsingborg, Sweden, as soon as possible after you have discovered the defect. If you lodge the complaint within two months from you discovering the defect, the complaint will always be considered as having been lodged in due time. However, if you do not lodge a complaint within three years from ordering the product, you will have no right to invoke the defect.

We will handle your complaint in accordance with applicable consumer protection legislation and with the guidelines provided by the Swedish National Board for Consumer Disputes (Allmänna Reklamationsnämnden, (”ARN”) (see www.arn.se).

Please note that even if we hope that you are very happy with your product, you are not entitled for compensation if the only reason for your complaint is that you are displeased with the product.

Force Majeure

Maria Nila is not liable for defects or delays caused by circumstances beyond our reasonable control, such as general labour disputes, war, fire, amendments to regulations issued by governmental authorities, issues with power mains or telephone communications, data transmissions or any other form of communication, or defects or delays in deliveries by sub-contractors.

Changes and additions

Maria Nila reserves the right to change and make additions to these Terms and Conditions at any time. You are bound by the Terms and Conditions valid at the time for your purchase. Changes and additions of these Terms and Conditions are valid for all purchases made after publication at marianila.com. For this purpose, please consult marianila.com on a regular basis.

We will be delighted every time we see our products in real life on social medias, and sometimes we may request to share these pictures and videos in our channels. The pictures or videos are published primarily on our website but may also be published in one of our other channels ex. Instagram, TikTok, Pinterest, newsletters, our magazine or in the store environment.

By responding #yesmarianilastockholm on a picture after Maria Nila’s request on Instagram, hereafter referred to as "picture(s)", you agree to the following:

You provide Maria Nila AB (corporate ID 556298-9540), a non-exclusive, royalty-free worldwide license to use any pictures you have responded with #yesmarianilastockholm, hereinafter referred to as ”picture", in their marketing and / or advertising, including in the gallery on the website, newsletters, catalogs, e-mail and other customer communications, store materials and other marketing purposes. Furthermore, you give Maria Nila your consent to use photos where you can be identified for marketing and / or advertising purposes, according to the Swedish Act on Names and Pictures in Advertising (Sw: Lag om namn och bild i reklam (1978:800)).

You represent and warrant that you own or control the rights to the material you have submitted and that you have permission from any person(s) appearing in the photos. Moreover, you certify that you are at least 18 years old or have parental consent, and that Maria Nila’s use of your pictures will not violate any rights of a third party or any law.

Hereby, you release Maria Nila from all obligations to pay you for the use of your pictures and freeing and agreeing to keep Maria Nila and all persons acting for Maria Nila from all claims (including claims from third party), liabilities, irrespective of nature, in connection with the use of the pictures as described above.

Swedish law governs these terms and conditions, where competent courts in Stockholm shall have exclusive jurisdiction of any dispute arising out of them.

Governing law and disputesIf a dispute should arise that we are not able to settle together, you may as a consumer apply to ARN. These Terms and Conditions shall be governed by and construed in accordance with the laws of Sweden. Any dispute arising out of these Terms and Conditions shall be finally settled by the general courts of Sweden.

Mobile message service

The Maria Nila mobile message service (the "Service") is operated by Maria Nila (“Maria Nila”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By sharing your phone number you consent to Maria Nila’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Maria Nila INC through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, recommendations, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Maria Nila INC. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +18449613757 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Maria Nila INC mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number. 

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
