The Maria Nila mobile message service (the "Service") is operated by Maria Nila (“Maria Nila”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By sharing your phone number you consent to Maria Nila’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Maria Nila INC through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, recommendations, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Maria Nila INC. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +18449613757 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Maria Nila INC mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number. 

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

Analytics and Personalization

We use personal information to conduct research and analytics, including to better understand Consumers’ needs, and to provide personalized recommendations about our products; to understand how you interact with our Website, advertisements, and communications with you to determine which of our products are the most popular, and to improve our Website, and marketing campaigns; and to personalize your experience, to save you time when you visit our Website.

Security and Fraud Prevention

We use personal information to detect, investigate, prevent, and take action against potential malicious, deceptive, fraudulent, or illegal activity, including attempts to manipulate or violate our policies, procedures, and terms and conditions, security incidents, and harm to the rights or property of Maria Nila and our users, employees, or others.

Enforcement of Legal Rights

We may disclose personal information to the extent they are necessary to enforce or protect our rights, privacy, safety or property, and/or that of our affiliates, you or others, including enforcing our Terms & Conditions and any other agreements (such as for billing and collection purposes and fraud prevention).

We do not knowingly collect contact or personal information from children under 13. Nor are the Website/Services intended to solicit information of any kind from children under 13. If we become aware that we have inadvertently received information from a child under 13, we will delete such information from our records. California users under the age of 18 may request the removal of their content or information publicly posted on the Website by e-mailing us at americas@marianila.com. Please note that most of the user content that appears on the Website is stored and controlled by third party providers; thus, complete and comprehensive removal of the content may not be possible. To make such a request, email us at americas@marianila.com with Children’s Privacy Request (under age 18) in the subject line, and include your full name, e-mail address, and address in your message. We will respond within 30 days or as otherwise required by law.

We take the protection of your personal information seriously. Maria Nila employees who have access to your personal information are made aware of the importance of keeping it confidential. However, no data security measures can guarantee complete security; we also depend on you to take common sense steps to ensure your personal information remains secure. Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Website. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on our Website.

Identity Verification

For us to process certain privacy rights requests, we will need to verify your identity to confirm that the request came from you. This is done to protect your identity and personal information. Depending on your request, we will ask for information such as your name and an email address that you have used with Maria Nila, or other personal information that you have previously provided to us. For certain requests, we may also ask you to provide other details but in no event will we ever attempt to collect any sensitive personal information such as any financial/banking information or your Driver’s License, Social Security, or Passport numbers.

Maria Nila does not collect any sensitive personal information for any customers or minors. If Maria Nila collects your sensitive personal information in the future, we will provide disclosures in this section and a right for you to limit the use of such information.

Your California Privacy Rights

Under the CCPA and CPRA, California residents have certain rights with respect to personal data about them we have collected. California residents are entitled to contact us to request information about whether we have disclosed personal information to third parties for the third parties’ direct marketing purposes.

California consumers have the right to:

  • Request disclosure of the categories and specific pieces of personal information that Maria Nila has collected about you;
  • Request disclosure of the categories of third-party sources, if any, from which Maria Nila has collected personal information about you;
  • Disclosure of the business or commercial purpose(s) for which your personal information has been collected by Maria Nila;
  • Receive a list of the categories of third parties with whom Maria Nila has shared your personal information;
  • Request that Maria Nila delete any personal information that it has collected from you (subject to exceptions);
  • Request that Maria Nila correct inaccurate personal information that Maria Nila has about you;

Before complying with your request, we will need to verify that it is you that is making the request. To accomplish this, you will be requested to confirm specific personal information that we already know about you. California consumers are limited to two requests for personal information per twelve (12) month period. Only you or an authorized agent may make a verifiable data subject request related to your personal information. The verifiable data subject request must provide sufficient information and documentation to allow us to verify that you (or an authorized agent) are the person about whom we collected personal information. We will not provide you with personal information if we cannot verify your identity and/or authority to make the data subject request and confirm the personal information belongs to you or the represented individual. We use personal information provided in a verifiable data subject request solely to verify the requestor's identity or authority to make the request.

We will respond to a verifiable data subject request within forty-five (45) days of its receipt. If we require more time, we will inform you of the reason and extension period which is an additional forty-five (45) days. We will deliver our response to electronically at the email address in your request. All disclosures we provide will only cover the twelve (12) month period preceding the verifiable request's receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable.

We do not charge a fee to process or respond to your verifiable data subject request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

 

Notice of Financial Incentive

We offer our customers a promotion code that provides a one-time discount on a purchase. We may also provide other programs, such as sweepstakes, contest, or other similar promotional campaigns (collectively, the “Programs”). When you sign up for one of these Programs, we typically ask you to provide your name and contact information (such as email and/or phone number). Because our Programs involve the collection of personal information, they might be interpreted as a “financial incentive” program under California law. The value of your personal information to us is related to the value of the free or discounted products or services, or other benefits that you obtain or that are provided as part of the applicable Program, less the expense related to offering those products, services, and benefits to Program participants.
